1. INTRODUCTION
Welcome to Bobby Air (“we,” “us,” “our,” or “Company”). These Terms and Conditions (“Terms”) govern your use of our website at bobbyair.ca (the “Website”) and the HVAC services we provide, including heating, ventilation, air conditioning installation, repair, and maintenance services (collectively, the “Services”).
By accessing our Website or engaging our Services, you (“Customer,” “you,” or “your”) agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Website or Services.

3. SERVICES PROVIDED
Bobby Air provides professional HVAC services throughout the Greater Toronto Area, including but not limited to:
- Air conditioning system installation, repair, and maintenance
- Furnace installation, repair, and maintenance (gas and electric)
- Heat pump installation, repair, and maintenance
- Emergency HVAC repair services (available 24 hours a day)
- Routine maintenance and inspection services
- Energy efficiency consultations
- HVAC system replacements and upgrades
4. SERVICE AGREEMENTS AND ESTIMATES
4.1 Estimates and Quotes
All estimates provided are valid for 30 days from the date of issue unless otherwise specified. Estimates are based on the information available at the time of inspection and may be subject to change if additional work or unforeseen issues are discovered.
4.2 Acceptance of Services
By authorizing work through written agreement, verbal confirmation, or electronic acceptance, you agree to the scope of work, pricing, and these Terms and Conditions.
4.3 Pricing
All prices quoted are in Canadian Dollars (CAD) and do not include applicable taxes unless otherwise stated. GST/HST and any other applicable taxes will be added to the final invoice.
4.4 Changes to Scope of Work
Any changes to the agreed-upon scope of work must be authorized in writing by the Customer. Additional work will be charged at our standard rates or as otherwise agreed upon.
5. PAYMENT TERMS
5.1 Payment Methods
We accept payment by cash, credit card, debit card, e-transfer, or other methods as agreed upon at the time of service.
5.2 Payment Schedule
- Emergency Repairs: Payment is due upon completion of service unless alternative arrangements are made in advance.
- Installation Projects: A deposit may be required before work begins, with the balance due upon completion.
- Maintenance Contracts: Payment terms as specified in the maintenance agreement.
5.3 Late Payment
Invoices not paid within 30 days of the invoice date will be subject to a late payment fee of 2% per month (26.82% annually) on the outstanding balance, or the maximum rate permitted by law, whichever is less.
5.4 Non-Payment
We reserve the right to suspend Services and/or pursue collection for any outstanding amounts. The Customer will be responsible for all reasonable collection costs, including legal fees.
6. SCHEDULING AND APPOINTMENTS
6.1 Appointment Scheduling
Service appointments can be scheduled by phone at (437) 922-9191 or through our Website contact form. We will make reasonable efforts to accommodate your preferred service time.
6.2 Service Windows
Standard service appointments are scheduled within designated time windows. We will provide advance notice if we are unable to meet the scheduled time.
6.3 Cancellations and Rescheduling
- Customers must provide at least 24 hours’ notice to cancel or reschedule an appointment.
- Cancellations with less than 24 hours’ notice or no-show appointments may be subject to a cancellation fee of up to $75.
- Bobby Air reserves the right to reschedule appointments due to emergency service calls, weather conditions, or other unforeseen circumstances.
6.4 Access Requirements
The Customer must provide safe and unobstructed access to all areas where work is to be performed. If access is not provided as agreed, Bobby Air reserves the right to reschedule and charge a service call fee.
7. WARRANTIES AND GUARANTEES
7.1 Workmanship Warranty
We warrant that all work performed will be free from defects in workmanship for a period of one (1) year from the date of completion, unless otherwise specified in writing.
7.2 Equipment and Parts Warranty
Equipment and parts are covered by the manufacturer’s warranty. Warranty terms and duration vary by manufacturer and product. We will provide warranty information at the time of installation or sale.
7.3 Warranty Limitations
Our warranties do not cover:
- Damage caused by improper use, negligence, or accidents
- Normal wear and tear
- Damage caused by acts of God, including but not limited to floods, fires, storms, or earthquakes
- Damage caused by unauthorized modifications or repairs by third parties
- Failure to perform recommended maintenance
- Issues arising from improper installation not performed by Bobby Air
7.4 Warranty Claims
To make a warranty claim, contact us promptly at (437) 922-9191 or Customair.ca@gmail.com. We will inspect the work and, at our discretion, repair or replace defective work at no charge if covered under warranty.
8. CUSTOMER RESPONSIBILITIES
8.1 Accurate Information
You agree to provide accurate and complete information regarding the property, existing HVAC systems, and any known issues that may affect the Services.
8.2 Property Preparation
You are responsible for:
- Clearing the work area of personal belongings and ensuring safe access
- Protecting or removing valuables near the work area
- Ensuring pets are secured away from work areas
- Providing adequate lighting and power outlets
- Notifying us of any hazardous materials (asbestos, lead, mold, etc.)
8.3 Permits and Approvals
While we will advise on required permits, the Customer is ultimately responsible for obtaining necessary permits, approvals, or permissions from landlords, property management, or condominium boards as applicable.
8.4 Maintenance
Regular maintenance of HVAC systems is the Customer’s responsibility. Failure to perform recommended maintenance may void warranties and affect system performance and longevity.
9. LIMITATION OF LIABILITY
9.1 Service Limitations
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOBBY AIR’S LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO OUR SERVICES SHALL BE LIMITED TO THE AMOUNT PAID BY THE CUSTOMER FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
9.2 Exclusions
BOBBY AIR SHALL NOT BE LIABLE FOR:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, REVENUE, DATA, OR USE
- DAMAGE TO PROPERTY NOT DIRECTLY CAUSED BY OUR NEGLIGENCE
- DELAYS OR FAILURES DUE TO CIRCUMSTANCES BEYOND OUR REASONABLE CONTROL
9.3 Pre-Existing Conditions
We are not responsible for pre-existing defects, code violations, or conditions in the property that are discovered during or after service provision, unless we specifically agreed in writing to address such conditions.
10. EMERGENCY SERVICES
10.1 Availability
Emergency HVAC services are available 24 hours a day, 7 days a week by calling (437) 922-9191.
10.2 Emergency Rates
Emergency service rates may differ from standard rates due to after-hours, weekend, or holiday scheduling. You will be informed of applicable rates before service is authorized.
10.3 Emergency Response
While we strive to respond to emergencies as quickly as possible, response times may vary based on weather conditions, service demand, and technician availability.
11. INTELLECTUAL PROPERTY
All content on the Bobby Air website, including but not limited to text, graphics, logos, images, and software, is the property of Bobby Air or its content suppliers and is protected by Canadian and international copyright laws. You may not reproduce, distribute, or create derivative works without our express written permission.
12. PRIVACY AND DATA PROTECTION
We collect, use, and protect your personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA). Please refer to our Privacy Policy for details on how we handle your information.
13. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Bobby Air, its officers, employees, contractors, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:
- Your breach of these Terms
- Your misuse of our Services
- Your violation of any applicable laws or regulations
- Any misrepresentation or false information provided by you
14. FORCE MAJEURE
Bobby Air shall not be liable for any delay or failure to perform Services due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, pandemic, epidemic, or supplier failures.
15. DISPUTE RESOLUTION
15.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
15.2 Jurisdiction
Any disputes arising from these Terms or the Services provided shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
15.3 Informal Resolution
In the event of a dispute, both parties agree to first attempt to resolve the matter informally through good-faith negotiations before pursuing legal action.
16. SEVERABILITY
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
17. MODIFICATIONS TO TERMS
Bobby Air reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to our Website with an updated “Last Updated” date. Continued use of our Services after modifications constitutes acceptance of the revised Terms.
18. ENTIRE AGREEMENT
These Terms, together with any written service agreements, estimates, or invoices, constitute the entire agreement between you and Bobby Air regarding the Services and supersede all prior or contemporaneous communications and proposals.
19. WAIVER
No waiver of any term or condition of these Terms shall be deemed a continuing waiver or a waiver of any other term or condition. Bobby Air’s failure to enforce any right or provision shall not constitute a waiver of such right or provision.
